Policies, Waivers & Agreement

Effective: August 2025

By booking or participating in any LifeGuardians service, you agree to the following terms:

Privacy Policy

Life-Guardians values your privacy and is committed to protecting your personal data. This policy explains how we collect, use, and protect the information you provide.

What We Collect:
  • Name, email, phone number

  • Event or course information (dates, locations, participants)

  • Any medical concerns voluntarily disclosed

  • Consent responses (waivers, releases, agreements)

How We Use It:
  • To schedule and confirm services

  • To provide updates or changes regarding courses/events

  • To process certifications or waivers

  • To send promotional materials (only if opted in)

Your Data Rights:
  • You can request data deletion at any time

  • You can unsubscribe from promotional emails at any time

  • We do not sell or share your personal data with third parties

Terms & Conditions

These Terms apply to all services offered by Life-Guardians: Private Lifeguarding, Lifeguard Certification Courses, and CPR/AED & First Aid Courses.

General:
  • Booking confirmation requires written agreement and/or payment

  • Services are subject to availability and location

  • All participants must meet service-specific requirements

Private Lifeguarding Services (Up to 25 Swimmers):
  • Lifeguard is responsible for water safety and pool supervision

  • Clients are responsible for ensuring children follow posted rules and lifeguard instructions

  • Additional lifeguards may be required for events exceeding 25 swimmers

Lifeguard Certification Course (Max 10 Students):
  • Students must meet age and physical requirements outlined in course materials

  • Certification is based on performance, not attendance alone

CPR/AED & First Aid Courses (Max 12 Students):
  • Open to all ages; parental consent required for minors

  • Certification awarded upon completion of all course components

Safety Rules & Ratios

  • One lifeguard may supervise up to 15 swimmers.

  • If all swimmers are strong and at least 8 years old, one lifeguard may supervise up to 20 swimmers.

  • Children under 5 must remain within arm’s reach of a parent or guardian while in the water.

  • Large, non-transparent rafts or excessive rafts are not permitted.

  • Diving boards may not be used while Life-Guardians lifeguards are on duty.

  • Slides require the presence of an additional lifeguard.

  • Lifeguards have authority to restrict unsafe activities or remove equipment.

  • If unsafe conditions are not remedied after warning, lifeguards may end services early. No refunds will be issued.

Booking Changes & Rescheduling

  • One reschedule is permitted free of charge if made at least 48 hours before the scheduled service.

  • Additional reschedules may incur a $30 administrative fee.

  • All booking changes must be confirmed by phone call to Life-Guardians.

Cancellation & Refund Policy

Private Lifeguarding:
  • Full refund with 48+ hours notice

  • Rescheduling permitted once if notice is given within 24–48 hours

  • No refund for cancellations made within 24 hours or for no-shows

Lifeguard Certification Courses:
  • Fees are non-refundable once booked

  • One-time rescheduling allowed with 72+ hours notice

  • No refund or rescheduling for no-shows or late arrivals beyond 15 minutes

CPR/AED & First Aid Courses:
  • Full refund if canceled 48+ hours before course

  • 50% refund with 24–48 hours notice

  • No refund within 24 hours or for no-shows

Rush Bookings

  • Bookings made within 48 hours of the event may be subject to a $50 rush fee per lifeguard.

  • All rush requests must be confirmed by phone call.

  • If a lifeguard cannot be secured, a full refund will be issued.

Minimum Hours & Payment

  • Lifeguards are booked with a minimum of 3 hours.

  • If released early, the full contracted time will still be billed.

  • Payment must be processed directly through Life-Guardians. Lifeguards cannot accept direct payment.

  • Tips are always appreciated but never expected.

Client Responsibilities

  • Clients must ensure participants comply with lifeguard instructions at all times.

  • Clients must disclose any medical or behavioral concerns that may affect safety.

  • If unsafe behavior continues after warning, lifeguards may end services early without refund.

Force Majeure (Uncontrollable Events)

Life-Guardians is not responsible for cancellations, delays, or failure to provide services caused by events beyond our control, including severe weather, natural disasters, accidents, illness, or emergencies. Refunds or rescheduling will be handled at Life-Guardians’ discretion.

Medical Emergency Protocol

Life-Guardians lifeguards are trained in CPR, AED use, and First Aid but are not emergency medical personnel. In the event of a life-threatening emergency:

  • Clients or guardians must call 911 immediately.

  • Lifeguards may provide emergency care within the scope of their training until EMS arrives.

Indemnification Clause

By booking with Life-Guardians, clients agree to indemnify, defend, and hold harmless Life-Guardians and its representatives from any claims, damages, or expenses arising from:

  • Negligence by guests or participants

  • Unsafe facilities or equipment

  • Failure to follow lifeguard instructions or safety rules

Explanation:

This means if an incident occurs because of unsafe actions by guests, failure to follow safety directions, or hazards at the facility, the client is responsible for all related costs or legal claims — not Life-Guardians.

Certification Disclaimer

This applies to both Lifeguard Certification and CPR/AED & First Aid Courses:

  • Certification is not automatic. To receive certification, participants must:

    • Attend and complete all course sessions

    • Successfully perform all physical and rescue skills

    • Pass written assessments with minimum required scores

  • Failure to meet these requirements results in non-certification. No refunds will be issued for failure to certify.

Photo & Media Release

Life-Guardians may request permission to capture photos or short video clips during courses or events for promotional purposes. Photos or recordings will only be taken if the client provides consent in advance. Clients may choose to decline without any impact on their participation or services.

Emergency Disclaimer

Life-Guardians is not an emergency response agency. In the event of a life-threatening emergency, clients must call 911 or local emergency services immediately. Our services are preventative, instructional, and supervisory, but do not replace EMS, fire/rescue, or other emergency medical teams.

Waiver of Liability

All participants and clients must sign a separate Liability Waiver before receiving any service. By signing, clients acknowledge:

  • They understand and accept the risks associated with swimming, physical exertion, CPR, and emergency response training

  • They release Life-Guardians and its representatives from liability for injury, loss, or accident resulting from participation

  • They agree to follow all instructions, safety rules, and procedures during any event or class

  • They will disclose any relevant medical or behavioral information that may affect safety

  • Clients who do not submit a signed waiver will be ineligible for participation in any service

Code of Conduct / Adult Supervision

  • A responsible adult host must be present at all times during private lifeguarding events.

  • Lifeguards are not a substitute for parental or adult supervision.

  • If no responsible adult is present, lifeguards reserve the right to end services early without refund.

Alcohol & Substance Policy

  • For the safety of all participants, supervising adults must not be under the influence of alcohol or substances during the event.

  • If lifeguards determine that intoxication impairs supervision or creates an unsafe environment, services may be ended early without refund.

Incident Reporting

  • All injuries, accidents, or safety-related incidents must be reported immediately to the lifeguard on duty.

  • Clients must also notify Life-Guardians management following the event to ensure proper documentation.

Jurisdiction & Governing Law

These policies and agreements shall be governed by and construed in accordance with the laws of the State of California. Any disputes shall be resolved in the courts located within California.
